TERMS OF SALE

INTRODUCTION
The present Conditions of sale have as object the purchase of products, done at distance through the site frantoiovallone.it (and the domains connected to it), managed by Antico Frantoio Vallone, registered office C/da Fontana della Pietra, Via Gammara 91011 Alcamo (TP) in Sicily, Tax Code/VAT number 01251560817 - owner of the site http://www.frantoiovallone.it. Every purchase transaction will be governed by the provisions of Legislative Decree n. 185/99 and, for the protection of confidentiality, will be subjected to the legislation pursuant to Legislative Decree 196/2003.

The order sent by the customer has the value of a contractual proposal and the Customer explicitly states that he/she has complete knowledge and fully accepts these General Terms and Conditions of Sale:

1. PRICES
   The prices shown on our site include VAT.
   The price on the order confirmation that the customer will receive at the email address indicated at the time of registration will be authentic.

1. ORDERS
   The customer can only purchase products in the electronic catalog www.frantoiovallone.it at the time of the order, illustrated in detail and described in the relevant information sheets. It's understood that the image accompanying the description of a product may not be fully representative of its features but may differ in color and size. The publication of the products on the site is an invitation to the customer to make a contractual purchase proposal to Antico Frantoio Vallone. The correct reception of the customer's proposal is confirmed by Antico Frantoio Vallone through an e-mail reply, sent to the e-mail address communicated by the customer. This confirmation message will contain an “Order Number”, to be used in any further communication with Antico Frantoio Vallone. The message re-proposes all the data entered by the customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document. Each purchase agreement stipulated between Antico Frantoio Vallone and the customer must be considered concluded with the acceptance of the order by Antico Frantoio Vallone. Antico Frantoio Vallone has the right to accept or not the order sent by the customer, without the latter being able to make any kind of rights in case of non-acceptance of the order. In the case of non-acceptance of the order, Antico Frantoio Vallone guarantees timely communication to the customer, at the addresses provided by the same, and the return of any amounts paid. Any right of the customer to compensation for damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and/or things, caused by the non-acceptance, even partial, of an order is excluded.
   
   The products available for shipment are highlighted on the site. The customer acknowledges that, due to the possible simultaneous access to the site by several users, the actual availability of the individual products may vary significantly during the same day with respect to the indications given on the site.

   The order will be processed as soon as possible, subject to stock availability.
   The minimum unit accepted for the order is the single package.

1. PAYMENT
   The accepted payment methods are credit card (credit card or paypal), bank transfer, postal payment and cash on delivery. For purchases less than € 120,00 the shipping cost is € 10,00; for purchases over € 120,00 the cost of shipping is free.
   Discount codes are not cumulative.

1. SHIPMENTS AND DELIVERIES
   Antico Frantoio Vallone will deliver the products, exclusively on the national territory, generally within 7 working days, from the moment of payment receipt, at the address indicated by express courier. Deliveries will be at the risk of Antico Frantoio Vallone until delivery of the products to the shipper or carrier appointed by Antico Frantoio Vallone for delivery.
   The Customer agrees to receive the order even within 30 (thirty) days from receipt of the order by Antico Frantoio Vallone, without this being considered a contractual non-fulfillment. The delivery times refer to the products in stock at the time of the purchase order.
   The customer acknowledges that, due to the possible simultaneous access to the site by several users, the actual availability of the individual products may vary significantly during the same day with respect to the indications given on the site.
   Unless otherwise notified to the customer, delivery is intended as street plan.
   In order to deliver the ordered products, the presence of the customer or his representative is always required in the same place indicated and on the day scheduled for delivery.
   Upon delivery of the products by the courier, the customer is required to check that the number of packages delivered corresponds to what is indicated in the transport document and that the packaging is intact, undamaged or otherwise altered, checking with particular care the possible presence of signs indicating the breakage of the products sent, such as, for example, the presence of leaked liquids and/or the presence of moisture on the packaging.
   Any damage to the packaging and/or products and/or the mismatch in the number of packages must be immediately reported to the courier by the customer, who must declare, in writing, to the person that delivering the products, that they are accepted with "content verification reserve". The customer also undertakes to promptly report, and in any case not later than 14 (fourteen) days from the date of delivery, to Antico Frantoio Vallone by registered letter with acknowledgment of receipt to the address C/da Fontana della Pietra Alcamo (TP) in Sicily and by email at: info@frantoiovallone.it any problems concerning the physical integrity, correspondence and/or completeness of the products received.
   It's possible to indicate a destination of the products different from that of the billing address. If the different destination doesn't appear in the order confirmation, due to an error, or is subsequently requested by the customer, it will be necessary to request the re-issuance of the corrected order confirmation to be certain that during order fulfillment it will be respected alternative address. In the event that, for any reason, the delivery address other than the billing address doesn't appear on the order confirmation and the customer doesn't request the correction and the subsequent reissue of the confirmation, the delivery will be made to the address billing declining all responsibility for everything that may derive from it.

1. BILLING
   For each order, that is in effect a purchase contract, perfected through www.frantoiovallone.it, Antico Frantoio Vallone will issue an invoice for the products that will be shipped. It's mandatory to communicate the tax code and/or VAT number, SDI code and PEC. In the case of a private customer a courtesy invoice will be sent along with the ordered goods and you will find it inside the package. If you have a VAT number you will be sent a cognitive delivery note inside the package and you will find the invoice in your tax drawer.
   The information provided by the customer during registration will be the same as those used for issuing the invoice. The customer assumes all responsibility for the correctness of the aforementioned information. No change in the invoice will be possible after the issuance.

1. RIGHT OF WITHDRAWAL
   Pursuant to Legislative Decree 206/2005, the right of withdrawal applies to natural persons (consumers) who act for purposes that are unrelated to any business.
   Therefore, purchases made by retailers and companies are excluded from the right of withdrawal.
   According to Legislative Decree 206/2005, art. 64, the customer has the possibility to exercise the right of withdrawal, without any penalty and without specifying the reason, within 14 working days from receipt of the order, by registered letter with return receipt to be sent to: Antico Frantoio Vallone, registered office C/da Fontana della Pietra 91011 Alcamo (TP). The aforementioned term is calculated from the day of receipt of the product.
   The sale of the products is subject to the legal guarantees provided for in articles 129, 130 and 132 of the Consumer Code. The customer has the right, at his/her choice and on condition that the type of product allows it, to restore, without charge, the conformity of the product by repair or replacement, or to an adequate price reduction or termination of the contract. The customer loses these rights if he doesn't report to Antico Frantoio Vallone. the lack of conformity within the period of 14 days from the date on which the defect was discovered, unless it's a product that by its nature is perishable or subject to expiry in a shorter term, in which case the defect must be reported within this reduced term.
   The products must be returned intact, inserted in their complete original packaging in all its parts and with adequate external packaging carefully sealed within 14 days from the communication of the withdrawal.
   If a damaged product is received, the information in point 4 applies.
   Transport costs for returns remain the responsibility of the customer, except in cases where the product doesn't comply with the order or damage.
   Antico Frantoio Vallone will reimburse the Consumer Customer for the full amount paid for the products purchased within 14 days of receipt of the goods on the bank account indicated by the customer of which he must be the holder or the joint holder.

1. CUSTOMER COMMITMENTS
   These conditions of sale must be examined online and accepted by the customers visiting the www.frantoiovallone.it site before they execute their purchase orders.

1. RESPONSIBILITY ANTICO FRANTOIO VALLONE
   In the case of "defective" products, the only burden for Antico Frantoio Vallone will be to replace it.
   Antico Frantoio Vallone assumes no responsibility for disruptions caused by force majeure of any kind and nature, in the event that it fails to execute the contract within the agreed time. Causes of force majeure, by way of example and not limited to, are the provisions of the Public Authority, the general and non-general strike of its own employees or the carriers of which Antico Frantoio Vallone uses, as well as any other circumstance that is outside of the latter's control.
